Khalil, a permanent resident and prominent protest leader, was arrested in early March, with his case drawing significant attention due to his US residency status. Judge Michael Farbiarz demanded an explanation and a history of similar uses of the law to justify deportations, likely leading to an appeal by the administration.
Critics argue that the rapid transfers of students to distant detention centers appear designed to undermine their due process rights, limiting access to legal representation. The courts’ recent actions signal a potential pushback against the administration’s aggressive stance towards dissenters.
As Ozturk’s and Khalil’s cases progress, the Trump administration must navigate these legal challenges, potentially escalating to the Supreme Court, amid growing scrutiny over its treatment of politically active students.
