Roxanne Tickle sued the app and founder Sally Grover for revoking her account after assuming she was male based on her photo. The Federal Court ordered Giggle for Girls to pay Tickle A$10,000 plus legal costs for indirect gender identity discrimination, but did not mandate a written apology.
This ruling, the first of its kind since changes to the Sex Discrimination Act in 2013, is seen as a victory for transgender women in Australia. Professor Paula Gerber at Monash University emphasized that it is unlawful to treat transgender women differently from cisgender women and make judgments based on appearance. Giggle for Girls, marketed as a safe space for women, had considered only sex at birth in determining a person’s gender identity.
Despite the judgment, founder Sally Grover expressed disappointment and stated that the fight for women’s rights continues. Roxanne Tickle, on the other hand, described the verdict as healing, having faced online hate and ridicule. She highlighted the discrimination faced by transgender and gender diverse individuals simply for being who they are.
